OPEN ONLY TO ELIGIBLE LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA WHO, AS OF THE TIME OF ENTRY, ARE AT LEAST 18 YEARS OLD.
VOID IN ALL JURISDICTIONS OTHER THAN THOSE STATED ABOVE AND WHERE PROHIBITED OR RESTRICTED BY LAW.
Eligibility: The Mos Back to School 2023 Giveaway (“Sweepstakes”) is open to legal residents of the 50 United States and District of Columbia. Entrants must be 18 years or older as of their date of entry in this promotion in order to qualify. This Sweepstakes is subject to federal, state, and local laws and regulations and void where prohibited by law. The following individuals are not eligible to enter or win a prize: employees, representatives, agents, directors, and officers of the Sponsor, its parents, subsidiaries, affiliated companies, and marketing agencies, or of any other parties involved in the administration of the Sweepstakes (Sponsor, collectively with the foregoing, the “Sweepstakes Parties”) and each of the immediate family members of such excluded individuals (i.e., spouses, parents, children, siblings and the “steps” of each) and all persons living in the same household of each.
Sponsorship. The sponsor is Askmos, Inc. (d/b/a Mos) (“Sponsor”), located at 660 4th Street, Suite 193, San Francisco, California 94107. Sponsor will conduct the Sweepstakes as described in these Official Rules.
Agreement to Rules: By entering this Sweepstakes, the entrant (“You” or “Entrant”) agrees to abide by these official rules (“Official Rules”) and Sponsor’s decisions, which are fully and unconditionally binding in all respects. The Sponsor reserves the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s sole discretion. By entering this Sweepstakes, You represent and warrant that You are eligible to participate based on eligibility requirements explained in the Official Rules. You also agree to accept the decisions of the Sponsor as final and binding as it relates to the content of this Sweepstakes. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations.
Mos Back to School 2023 giveaway (Sweepstakes) Entry Period: This promotion begins on 9:00am EDT on September 1, 2023 and ends on 6:00pm EDT on September 30, 2023 (“Entry Period”). To be eligible for the Sweepstakes, entries must be received within the specified Entry Period. Sponsor’s computer is the official time keeping device for the Sweepstakes.
How to Enter: NO PURCHASE NECESSARY AND NO ENTRY FEE, PAYMENT OR PROOF OF PURCHASE IS NECESSARY TO PARTICIPATE. There are multiple methods of entry to the Sweepstakes: 1. Creating Mos Account: Receive one entry by creating a Mos account (free to create) (“Mos Account”) via the Mos mobile application (“Mos App”) during the Entry Period. Maximum 1 entry per person using this method. Or 2. Making a Referral: This method is only available to Mos Account holders. Enter by submitting a Verified Referral (as defined in the Referral Program Terms) via Sponsor’s Referral Program during the Entry Period. Entrants via this method shall be subject to the Sponsor’s Referral Program Terms and Conditions found on the Mos App (“Referral Program Terms”). Or 3. Alternative Postal Mail Method of Entry: You can also enter the Sweepstakes by legibly hand printing your full name, complete postal address (including zip code), home telephone number, e-mail address and the words “Mos Back to School 2023 Giveaway” on a plain 3” x 5” card or piece of paper and mailing it with proper postage affixed in a sealed #10 envelope to: Mos, ATTN: Growth team, at 660 4th Street, Suite 193, San Francisco, California 94107. You will receive one (1) entry for each completed eligible mail-in entry received, subject to the entry limitation stated below. Each mail-in entry must be postmarked by September 30, 2023 and received by Sponsor no later than October 5, 2023. Sweepstakes Parties assume no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage-due entries or mail. No mechanically reproduced entries permitted. Illegible/incomplete entries are void. Compliance with the entry requirements will be determined by Sponsor in its sole discretion. Entries that violate, as determined by the Sponsor, in its sole discretion, these entry requirements or do not meet the entry deadlines will be disqualified from the Sweepstakes.
Prizes: Two (2) winners (the “Winners”) will each receive one (1) Apple MacBook Pro 13” with an approximate retail value (“ARV”) of $1,299 each. The total ARV of all prizes offered in the Sweepstakes is $2,598. All amounts are in United States dollars. The actual prize value may differ at the time the prize is awarded. Each Entrant may only win one (1) prize in the Sweepstakes. There shall be no cash or other prize substitution permitted except at the Sponsor’s discretion. The prize is subject to availability and if the prize cannot be awarded for any reason, Sponsor reserves the right in its sole discretion to substitute the prize with one of comparable or greater retail value. A Winner shall not transfer assignment of the prize to others nor shall a Winner request the cash equivalent or prize substitution. Rights to the prize are non-transferable. The Winners, upon acceptance of the prize, are solely responsible for all costs and expenses related to the prize and prize acceptance not specifically provided herein, including without limitation any and all local, state, and federal taxes. Each Winner agrees and acknowledges that Sponsor may be required to withhold and remit a portion of prize value to comply with applicable tax laws. Each Winner must provide the Sponsor with a valid Social Security number or taxpayer-identification number or any other information Sponsor may require in connection with applicable tax reporting or withholding requirements or other laws or regulations before the Sponsor can award the prize. As a condition of receiving the prize, a Winner must provide Sponsor with a valid mailing address. Sponsor will pay for the cost of delivering the prize to Winner within the United States. The method of shipping and the carrier will be determined in the sole discretion of Sponsor. Sponsor is not responsible for any prizes that are lost, stolen, undeliverable, or returned. EACH WINNER AGREES TO ACCEPT THE PRIZES “AS IS”, AND ENTRANTS HEREBY ACKNOWLEDGE THAT SWEEPSTAKES PARTIES HAVE NEITHER MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE PRIZES, INCLUDING BUT NOT LIMITED TO (A) ANY EXPRESS WARRANTIES PROVIDED EXCLUSIVELY BY A PRIZE SUPPLIER THAT ARE SENT ALONG WITH THE PRIZE OR (B) THEIR QUALITY OR MECHANICAL CONDITIONS. SPONSOR HEREBY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT.
Odds: The total number of eligible entries received determines the odds of winning.
Selection and Notification of Winner: The Winners will be selected on or about October 6, 2023 by a random drawing under the supervision of the Sponsor. The Sponsor will attempt to notify the Winners by email to the email address provided in the entry or the email address associated with the Entrant’s Mos Account within ten days following Winner selection. The Sponsor is not responsible for nor shall it have any liability for Winner’s failure to receive notices due to email security settings that may cause notifications to be marked as spam or junk email. Nor shall be Sponsor be liable for the Winner’s provision of incorrect or otherwise non-functioning contact information. If the Winner 1) fails to claim the prize within 30 days from the time the award notification was sent, 2) is found ineligible or disqualified by Sponsor, or 3) does not complete and return an executed declaration and release or any other information or documentation requests within the specified timeframe, the Winner will be disqualified and forfeit all interest in the prize, and an alternate Winner may be selected. Receipt of the prize by the Winner is upon the condition of compliance with any and all federal, state, and local laws and regulations. IF THE WINNER VIOLATES ANY OF THESE OFFICIAL RULES, THE WINNER (AT THE SPONSOR’S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED, INCLUDING FORFEITURE OF ALL INTEREST IN THE PRIZE. The Winners are subject to verification, including verification of age and residency.
Rights Granted by You: Except where prohibited by law, by accepting a prize, the Winner hereby grants Sponsor and its representatives an irrevocable, perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display the Winner’s name and information about the prize award, in any way, at any time, in any and all media, including without limitation, for use in advertising and marketing, without any additional approval or consideration. By accepting a prize, the Winner represents and warrants that they have the right to grant the foregoing license.
Terms & Conditions: In its sole discretion, the Sponsor reserves the right to modify, suspend, cancel, or terminate the Sweepstakes should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Sponsor’s control, impact or corrupt the security, fairness, proper conduct, or administration of the Sweepstakes. The Sponsor, in the event of any of the above issues, may determine the Winner based on all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Individuals who tamper with or attempt to tamper with the operation or entry process of the Sweepstakes or website or violates these Official Rules will be disqualified by the Sponsor in its sole discretion. In its sole discretion, the Sponsor has the right to maintain the integrity of the Sweepstakes, to void Entries for any reason, including, but not limited to: multiple signup entries from the same user; the use of bots, macros, scripts, or other technical means for entering; or violation of these Official Rules or the Referral Program Terms. LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning the prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or any Sweepstakes Parties.
Limitation of Liability: The Sweepstakes Parties assume no liability and are not responsible for, and by entering the Sweepstakes you hereby waive and release the Sweepstakes Parties from, any actions, claims, damages, losses or injuries of any kind (collectively “Claims”) arising in connection with the Sweepstakes and/or the receipt, use or misuse of any prize, including without limitation, Claims relating to: (i) the malfunction of any computer, telephone, mobile device, network, satellite, hardware, software or communications line; (ii) unauthorized human intervention; (iii) incorrect, delayed or inaccurate transmission, winner notifications, prize claims or other information or communications relating to the Sweepstakes, or the failure to capture or transmit any such information; (iv) damage to any person’s computer or mobile device; or (v) any errors in these Official Rules, winner notifications or other announcements or communications relating to the Sweepstakes. In the event of any ambiguity or error(s) in these Official Rules, Sponsor reserves the right to clarify or modify these Official Rules however it deems appropriate to correct any such ambiguity or error(s). If due to an error or for any other reason, more legitimate prize claims are received than the number of prizes stated in these Official Rules, Sponsor reserves the right to award only two (2) prizes from a random drawing of all eligible entries. In no event will more than the stated number of prizes (i.e., two prizes) be awarded. For California Residents Only: You hereby waive California Civil Code Section 1542, which states, “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
Additional Terms: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the rights and obligations of entrants and the winner, and the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE (I) THE SWEEPSTAKES PARTIES SHALL NOT BE RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES ARISING OUT OF OR CONNECTED WITH (A) THE SWEEPSTAKES OR (B) ANY PRIZE AWARDED, AND (II) YOUR REMEDIES FOR ANY CLAIMS RELATING THE SWEEPSTAKES ARE LIMITED TO YOUR ACTUAL OUT-OF-POCKET EXPENSES OF PARTICIPATION IN THE SWEEPSTAKES (IF ANY).
Privacy Policy: Any personally identifiable information collected during an entrant’s participation in the Sweepstakes will be collected and used by Sponsor and its designees for the administration and fulfillment of the Sweepstakes and as otherwise described in these Official Rules and Sponsor’s privacy policy available at https://www.mos.com/privacy-notice/.
Winners List: You may obtain a copy of the Winner’s name(s) by sending your request via mail with a stamped, self-addressed envelope to: Mos, 660 4th St Unit 193, San Francisco, CA 94107. Requests must be received no later than sixty (60) days after the end of the Entry Period.
